Principles of protection / processing of personal data

In case you are our customer (e.g. in the e-shop) or you are a subscriber to our newsletters or visitor to our website, you entrust us with your personal data, for which we are responsible as the operator. Please be aware of the privacy policy, its principles and your rights under the Privacy Policy and the European Data Protection Regulation, also known as the GDPR.      

I.               Operator designation:

SWISS WATCHES, s.r.o. Company, with registered office: Pribinova 8, 811 09 Bratislava, CRN / Company ID: 44975813, registered in the Commercial Register of the District Court Bratislava I, sec. Sro., insert no. 60575/B, is the operator of the e-shop on the website www.wdl.sk, the reservation system on the website www.wdl.sk We process your personal data, which you have provided to us as the operator i.e. we determine how the personal data will be processed and for what purpose, for how long period of time, and optionally select other processors who are in legal relationship with us for the purpose of our business.

III.          The scope of personal data and the purposes of their processing:

We process the personal information you have provided to us for the following purposes:

(i)             provision of our services and fulfillment of contractual obligations (e.g. fulfillment of purchase contracts concluded on our e-shop) - your personal data in the name and surname, home address including postal code, date of birth, phone number, email address and bank account number we need to fulfill our obligations e.g. for processing your order, delivery (dispatch) of goods, refund of purchase price or related costs, resolution of complaints, etc.)

(ii)           bookkeeping - if you have purchased or otherwise acquired goods from our company, we need your personal information in the name and surname, home address including postal code, birth date and bank account number we need to be able to issue a tax receipt and further register the issued tax documents and to process them in the legal scope for the purpose of keeping our accounting and tax obligations. At the same time, we may also need all data relating to our contractual relationship for accounting and tax compliance purposes. See (i) above, since your order, delivery note and any other documents related to the delivery of our goods or services are the basis for bookkeeping. 

(iii)         marketing – sending newsletters - Your personal information (name and surname and/or e-mail address, possibly also home address, if you have provided it to us) is necessary to send information about our goods and services, watches industry and additional assortment news, sales promotions and bargains or other business announcements/offers. If you are our customer, we legitimately assume that you are interested in our news and offers, and therefore we will be sending them to you for a maximum during two years from your last order.

If you are not our customer, any newsletter will only be sent to you upon your consent within a period of two years from your approval.

Regardless of the basis on which we process your personal information for the purpose of sending marketing newsletters, you may revoke your consent at any time by using the voting link in each sent marketing email or by directly submitting your disagreement (withdrawal of consent) to our contact details (we recommend written or e-mail form for provableness).      

(iv)          we specifically state that if you have chosen to reserve a company (other seller) other than our company in our e-shop under the "reservation of goods" option, then we are in a contractual relationship with that other company and your personal information is solely for the purpose of making a reservation must be provided by our company to this third party with whom you have shown interest in booking the goods. Also in this case we fulfill our contractual obligation to provide you with a reservation requested by our contract partner. Companies different from us, where it is possible to make a reservation of goods within our e-shop are:

Your personal data is processed during the statutory limitation periods, or the period during which a claim can be made if the claim was not made within that period. If the legislation (e.g. due to the obligation to keep accounting documents archived - 10 years) provides for a longer period of mandatory retention of certain data or their media, we will keep it for the specified period.

IV.            Cookies *)

If you have accessed our website, your IP address is recorded as well as the page from which you are entering and staying on our website. We consider the use of cookies to measure the traffic of our website as our legitimate interest, as we believe that this will allow us to offer you better services and improve the look and information structure of our website. In any case, if our site uses the so-called cookies, they also enable a browsing mode in which you can disable the use of cookies, and your choice will not affect your ability to browse our site or restrict your ability to use the e-shop.

V.             Security and privacy / personal data protection

We protect personal data as much as possible in accordance with the degree of technical development. We take the necessary technical and organizational measures to protect your personal information from misuse, damage or destruction.

VI.          Transmission of personal data to third parties

Your personal information is in our environment accessible to our employees and associates for purposes related to our commitment to you or for the purposes set out in point III. and IV. principles. Likewise, your personal information may be disclosed to third parties in connection with the provision of our business, we make sure that these persons protect personal data in accordance with the law. 

VII.        Providing personal data outside the European Union

Personal data will only be processed in the territory of the European Union or in countries that, based on a decision of the European Commission, ensure an adequate level of personal data protection.  

VIII.      Your rights in relation to the protection of privacy / personal data

You have the right to receive information that we already fulfill within the content of this policy, you are reading now.

You have the right to the access, and within 15 days upon your request we will notify you, what your personal data we are processing and why.

You have the right to complete and change your personal information, upon which, at your request, we will complete or change your personal data, if your personal information has changed or is no longer up to date.

You have the right to limit the processing of your personal data by which you may limit the scope of your personal data or the purpose of processing them (e.g. by logging out of newsletters you restrict the purpose of processing your personal data so that they cannot be used for that purpose). You can also use this right if you think that we are processing your inaccurate personal data or if you think that we are processing it illegally, but do not want to delete all data.

You have the right to the portability of your personal data, based on which, if you are interested in transferring your personal data to someone else, we will proceed in the same way as using the right of access, except that we will send you information in a machine-readable form within 30 days of your request.

You have the right to erase (right to forget), if you wish, we will erase all your personal data we process from our system as well as from any other processors working for us. We need 60 days to secure the deletion right. If we are bound by the statutory obligation to register certain personal data carriers (e.g. tax documents) for a period of time specified by law, or if we need your personal information to fulfill our obligations to you or exercise our rights against you (e.g. court proceedings, claims, limitation periods, etc.), your personal data will be erased in such a range only after these periods have elapsed. You will be informed of the completion of the deletion by email.

You have the right to lodge a complaint with the Privacy / Personal Data Protection Office if you believe that we do not lawfully treat your personal data. If you are considering submitting such a complaint, we will, of course, be happy to contact you with your suspicion first, so that we can correct it.

We specifically mention (as already stated in art. III. point (iii) of this Policy that if you receive our "newsletters" containing advertising, business or other communications or articles, you may revoke your consent to send them at any time by using the revoke link in any sent marketing email or by sending directly your disagreement (withdrawal of consent) to our contact details (we recommend a paper or e-mail form for provableness).      

You have the right to object to the processing of your personal data. In this case, we may not further process personal data as an operator unless we demonstrate the necessary legitimate interest in the processing of personal data that outweighs your rights or interests or if we do not demonstrate the grounds for claiming the claim.

IX.          Secrecy

We assure you that our employees and associates who will process your personal information are obliged to keep your personal data and measures whose disclosure would jeopardize the security of your personal data confidental; the obligation of secrecy of these persons continues even after the termination of the obligations of these persons with our company. Your personal information will not be disclosed to third parties without your consent.

X.            Effectiveness

These Privacy Policy (Personal Data/information Processing Policy) is valid and effective since 25.05.2018, if it is published earlier, we follow them as issued earlier, which does not limit the current compliance with the privacy policy under the legislation effective until 25.05.2018 to this day.
